What Is an EAD?

An Employment Authorization Document (EAD) is a physical card that gives you the legal right to work in the United States. Unlike H-1B or L-1 status (which is employer-sponsored), an EAD is independently issued to you.

Who Needs an EAD?

  • ·**H-4 spouses** of H-1B holders with approved I-140s
  • ·**F-1 students** on OPT or STEM OPT
  • ·**Green card applicants** waiting for their card
  • ·**Asylum seekers** and other categories

The Most Important Change: Automatic Extension

As of 2024, USCIS significantly extended the automatic extension period for EAD renewals. If you file your renewal before your EAD expires, you may get an automatic extension of up to 540 days while your case is pending.

This applies to most EAD categories, but not all. Check the USCIS website or consult an attorney to confirm yours qualifies.

The 180-Day Filing Rule

Always file your EAD renewal 180 days before expiry. Here's why:

  1. 1.USCIS processing times can exceed 6 months
  2. 2.Filing early maximizes your automatic extension window
  3. 3.Gaps in EAD authorization mean gaps in work authorization — which can have tax and HR consequences

What to File

The EAD renewal is done via Form I-765. You'll need: - Completed Form I-765 - 2 passport-style photos - Copy of your current EAD - Supporting documentation (varies by category) - Filing fee (currently $520, unless fee waiver applies)

H-4 EAD Specifically

H-4 EAD is one of the most volatile categories — it has been subject to litigation and policy changes. As of 2026: - H-4 EAD automatic extension is available - Your H-1B spouse must have an approved I-140 for you to qualify for H-4 EAD - Your H-4 status must remain valid during the entire period
